Cunard Reimburses Guests in Post-Refit Lawsuit
NEW YORK, Nov. 22, 1995 -- Cunard has been advised that the United
States District Court for the Southern District of New York has preliminarily
approved for distribution by Cunard a proposed settlement package, which had
previously been agreed to by counsel for the parties and presented to the
Court in the case of Andrew Charleston-Coad et al vs. Cunard Line Limited. A
court hearing to consider final approval of the settlement of the class action
will be held in New York on January 30, 1996.
The settlement is a result of legal proceedings commenced by some passengers
who sailed aboard the Queen Elizabeth 2 in December 1994, following a major
refurbishment of the ship.
In the settlement, Cunard has agreed to a full refund of cruise fares paid,
and a travel credit in the amount of 100 percent of cruise fares paid; in
addition, passengers sailing transatlantic receive a $5,000 travel credit, and
those on the Christmas cruise receive a $2,000 travel credit; ancillary
expenses in specific individual cases and $250,000 in legal fees.
"We believe this settlement provides appropriate compensation and reconfirms
Cunard's commitment to our passengers," said Peter Ward, Chairman and Chief
Executive. "Passenger reaction to the refurbished QE2 has been very positive
since the work was completed."
